These Terms of Service (“Terms”) govern your use of the Vape Ave website and your purchases from Vape Ave (“Vape Ave,” “we,” “us,” or “our”), a vape retailer at Emerald Park, Unit 154, 4750 Yonge Street, 2nd Floor, North York ON M2N 5M6, Canada. By using this website or placing an order, you agree to these Terms.

Our Privacy Policy, Shipping Policy, and Warranty, Returns & Exchanges Policy form part of these Terms and are incorporated by reference. If you do not agree with these Terms, do not use this website.

This website and our products are strictly for adults of legal age in their province. Minors may not use this site, create an account, or purchase from us under any circumstances.

By using this website you represent that you are of legal age in your province. Misrepresenting your age to access this site or to purchase age-restricted products is prohibited. Age is confirmed before entering the site and verified again with valid government-issued photo ID at delivery and at in-store pickup. We cancel any order where the required verification cannot be completed, and we may refuse service to anyone we reasonably believe has attempted to get around age-verification requirements, including purchasing on behalf of a minor.

Warning: vaping products contain nicotine. Nicotine is highly addictive. Our products are intended for adult smokers and vapers and are not intended for pregnant or nursing women, people with heart conditions or other health concerns, or anyone advised by a health professional to avoid nicotine.

Nothing on this website is medical advice. Use all products according to the manufacturer’s instructions, including battery charging, storage, and handling instructions. Do not use any product, battery, or e-liquid that appears damaged, leaking, swollen, or otherwise unsafe. Keep all vaping products away from children and pets.

You are responsible for the information on your account being accurate, for keeping your password confidential, and for all activity that happens under your account. Tell us promptly if you believe your account has been accessed without your permission. We may suspend or close accounts used in violation of these Terms, including any attempt to misrepresent age.

Placing an order is an offer to purchase. We may accept or decline an order, and may cancel an accepted order where an item is unavailable, a pricing or listing error occurred, required age or identity verification cannot be completed, or we reasonably suspect fraud or purchase for resale. If we cancel an order you have paid for, we refund the payment in full.

All prices are in Canadian dollars and exclude applicable taxes, which are calculated and shown at checkout along with any delivery cost. Prices and product availability may change at any time without notice; obvious pricing errors do not bind us. We may set reasonable quantity limits per customer.

Payment is taken at checkout for online payment methods, or in store for pickup orders placed with in-store payment. Card details are handled by our payment processor; we never see or store your card number.

We ship within Ontario only, every delivery requires a signature and valid government-issued photo ID proving legal age, and pickup orders are verified the same way at the counter. Full details are in the Shipping Policy.

All sales are final. The only exception is a disposable device that arrives faulty from the manufacturer, brought to our store within 24 hours for review, as set out in the Warranty, Returns & Exchanges Policy.

We sell vaping products in accordance with applicable federal and Ontario law. Products purchased from us are for personal use only and may not be resold. We do not ship outside Ontario and do not export products.

You agree not to:

• circumvent or attempt to circumvent the age gate or any age or identity verification;
• probe, scan, disrupt, or attempt to gain unauthorized access to the website, its accounts, or its systems;
• use bots or scrapers to harvest content, prices, or personal information from the site;
• place fraudulent orders or use payment methods you are not authorized to use; or
• use the website in any way that violates applicable law.

We may suspend access, cancel orders, and involve authorities where appropriate.

The content of this website, including its text, design, graphics, and imagery, belongs to Vape Ave or its licensors and may not be copied or reused without permission. Product names, brand names, and logos belong to their respective manufacturers and are used here to identify the genuine products we sell.

The website is provided on an “as is” and “as available” basis. We work to keep it accurate and available but do not guarantee it will be uninterrupted or error-free, and product descriptions and imagery may occasionally contain inaccuracies, which we correct when found.

To the maximum extent permitted by applicable law, Vape Ave is not liable for indirect, incidental, or consequential losses arising from the use of this website, and our total liability in connection with an order is limited to the amount you paid for that order. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, and nothing in these Terms limits your statutory rights as a consumer.

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario. Any dispute will be resolved in the courts of Ontario, unless applicable consumer law gives you the right to another forum.

We may update these Terms from time to time. Changes take effect when posted on this page with an updated “last updated” date, and apply to orders placed after that date. If any part of these Terms is found unenforceable, the rest remains in effect.
